Exemption: Content Produced by Third Parties

Referent to 18 U.S.C. § 2257, the operators of the website are neither the primary nor secondary "producers" of any content depicting real or simulated sexual acts featured hereon. The operator of said website simply undertakes the activities of transmission, storage, retrieval, hosting, or formatting of content, which may show explicit sexual behavior, that appears on the website because of actions taken by third-party users. All portions of the website that display such user-furnished content are under the control of the relevant users. Consequently, the operators and owners of the website are exempt from compliance with Section 2257 records keeping and labeling obligations as stipulated in 28 C.F.R. §75.1(c)(4). Any content that is deemed illegal, obscene, harmful, harassing, defamatory or in any respect antithetical to the terms of use and policies of the website, may be removed at the sole discretion of the operator or owner, in keeping with 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c).

With regard to any visual depictions appearing on the website, for which the operators of the website may be considered “producers” or “secondary producers,” such depictions are not subject to the stipulations of 18 U.S.C. §§2257, 2257A and 28 C.F.R. 75 because they do not portray actual sexually explicit acts as specifically specified in 18 U.S.C §2256 (2) (A)(i)-(iv); they do not portray depictions of the genitals or pubic area created after July 27, 2006; they do not portray simulated sexually explicit acts created after the effective date of Title 18 U.S.C. §2257A; or, they were created prior to July 3, 1995.
